Mitigation

Both Consignor and Consigee have the duty to mitigate damages in case of cargo loss, damage or delay, which includes the duty to accept and salvage. The standard shall be the “practically worthless” test, so that only if the cargo is practically worthless for the intended use are the Consignor and/or Consignee absolved from the duty to accept and mitigate. If Consignor and/or Consignee fail to accept salvageable cargo they shall be considered to have abandoned it and shall only be entitled to whatever salvage value the Carrier or others can collect.
